Common legal questions

All practice areas →
Can I get divorced if my spouse does not agree?Family law
Yes. Your spouse’s consent is not always required. One spouse may apply for divorce when the statutory conditions are met, for example, when the spouses have been legally separated for more than one year (Civil Code, Article 3.55). Another option is a claim based on the other spouse’s fault (Article 3.60). Fault is presumed if a spouse is convicted of an intentional crime, is unfaithful, treats the other spouse or family members cruelly, or has abandoned the family and provided no care for more than one year.Family law →
Do I need an attorney if I am only being called as a witness?Criminal law
A witness is not required to have defense counsel. Before the interview, however, establish whether you are genuinely being called as a witness, since that status can change to suspect. A person who may give evidence about their own suspected offense cannot be interviewed under the ordinary witness procedure. Separate rules apply, often called “special witness” status in practice. A representative may attend, the person cannot be penalized for refusing to testify about their own conduct, and they may ask to be formally recognized as a suspect.Criminal law →
What should I do if I discover hidden defects after buying?Real estate law
Document the defects and notify the seller immediately. Photographs and a specialist’s or expert’s report can help show that the defect existed when ownership transferred. You can then ask the seller for a price reduction, repairs, or compensation. The seller is not responsible for defects the buyer knew about or could not have been unaware of when signing. The buyer also loses the right to rely on a defect if they fail to notify the seller within a reasonable time after discovering it or after they should have discovered it (Civil Code, Article 6.327). If the seller rejects the claim, the shortened two-year limitation period starts (Article 1.125(8)).Real estate law →
My contractor has stopped work and is not responding. Where do I start?Construction law
Start by gathering evidence. Record the work completed and the site’s condition with photographs, measurements, and, if needed, a specialist’s report. It may be difficult to prove later what was done. Then send a written demand to complete the contract within a specified period. A client may terminate if the contractor fails to start on time, works so slowly that timely completion is clearly impossible, or fails to correct defects within a reasonable deadline. Claims may also be made for the unused advance payment and losses, including the additional cost of having the work completed. Check whether insolvency proceedings have been started against the contractor.Construction law →
How long do I have to challenge a dismissal?Employment law
One month. The period starts when you learned, or should have learned, of the violation, usually when the dismissal order or notice was served, rather than on your last working day. Record the service date, keep the document, and apply to the Labor Disputes Commission. Other claims, such as unpaid wages or other employment rights violations, have a three-month deadline.Employment law →
What should I do if I receive a lawsuit or a court payment order?Civil law
Check the deadline first. For a lawsuit, the court sets a defense deadline of 14 to 30 days. For a court payment order, you have 20 days from service to object. Your defense must identify and include the evidence available to you, so start gathering documents immediately. If you fail to file a defense without a valid reason, the court may enter a default judgment at the plaintiff’s request.Civil law →
My insurer has denied my claim. What should I do?Insurance law
First obtain the insurer’s written decision with reasons and the complete claim file. These are essential to a challenge. Check which policy provision is cited and whether it applies to the event. Prepare a written complaint to the insurer, supported by an independent valuation or expert report. If no agreement is reached, a consumer may apply to the Bank of Lithuania, and the dispute may also be taken to court.Insurance law →
How long do I have to appeal a fine?Administrative law
A decision made by an authority outside court must be appealed within 20 calendar days after a copy is sent or issued. The appeal is submitted through the authority that made the decision and is heard by a district court. The court may allow a late appeal only for valid reasons. Explain those reasons specifically and provide supporting documents.Administrative law →
