Our client applied to Kaunas District Municipality for approval of a detailed plan and a change in the plot’s designated use. The municipality made the change conditional on the construction of roads and main utility infrastructure, or shared local infrastructure where technical obstacles prevented connection to the main networks.
The issue was whether changing the designated use could lawfully be made subject to that condition. We prepared a complaint challenging the decision.
The respondents initially opposed the complaint but granted the relief sought before the case was decided on its merits. Under the parties’ agreement, the respondent undertook to reimburse the client’s litigation costs.
