Appellate court overturns an unfavorable judgment against our clients
Stage at which the case concluded
The first-instance court ruled against our clients, but the appellate court overturned that decision and granted their counterclaim concerning the land boundaries.
The plaintiff asked the court to approve a surveyors’ boundary plan without the defendants’ consent. The defendants turned to our firm to protect their rights.
Our clients filed a counterclaim asking for the same plot’s boundaries to be established under a plan prepared at their initiative. The courts had to choose between the two plans. The first-instance court granted the plaintiff’s claim and dismissed our clients’ counterclaim.
We appealed on behalf of the defendants, asking the appellate court to overturn the judgment, dismiss the claim, and grant the counterclaim. The appellate court granted the appeal and issued a new judgment granting the counterclaim and awarding our clients all litigation costs.
The appellate court overturned the unfavorable first-instance judgment.
