Court adopts the client’s proposed arrangement for using jointly owned land
Stage at which the case concluded
Two people owned shares in a plot of land. Our client asked the court to establish a use arrangement based on a boundary plan prepared at his initiative. The defendant filed a counterclaim.
The court had to assess whether the proposed arrangement respected both co-owners’ rights and complied with the law.
The court found that the proposal favored neither party, reflected their ownership shares, and did not objectively create grounds for future conflicts over use. It was rational, allowed efficient and economical use of the land, and complied with legal requirements. The claim was granted and the counterclaim dismissed.
The co-owners could not agree on how to use their shared land. The court adopted our client’s proposed arrangement and dismissed the counterclaim.
