Defamation claim dismissed; defendants awarded all attorney fees

Four defendants contacted our firm after being sued over statements alleged to be false and harmful to the plaintiffs’ honor, dignity, and business reputation. The plaintiffs also sought LTL 75,000 in compensation for nonfinancial harm.
The court had to decide whether the defendants’ submission to a supervisory authority contained factual allegations about the plaintiffs or expressed the defendants’ opinions. That distinction determined whether liability for infringement of honor and dignity could arise.
We established that the submission expressed the defendants’ opinions, that they had objective grounds to approach the supervisory authority, and that they had not disseminated factual allegations about the plaintiffs. The claim was dismissed, and the defendants were awarded all attorney fees.
The court dismissed the claim concerning honor and dignity, including the demand for LTL 75,000 for nonfinancial harm, and awarded our clients all attorney fees.
